By submitting an application, paying any fee, ticking "I agree", or allowing attendance, you accept these Terms on your and the student's behalf.
1. Enrolment, Fees, Payment Terms, and Cancellations
1.1 Enrolment is confirmed once payment for the first term or session is received or a written payment plan is agreed by the Academy.
1.2 Fees are payable in advance per term or as otherwise agreed in writing. The Academy may require a deposit to hold a place.
1.3 Late payment: If an invoice is not paid by its due date, the Academy may suspend tuition until payment is made. A reasonable dishonour/late fee may also be charged to cover administrative costs. You agree to pay the Academy's reasonable costs of collection (including legal costs on an indemnity basis) to the extent permitted by law.
1.4 Non-attendance and cancellations by you: Missed or cancelled lessons are non-refundable and not credited unless the Academy agrees otherwise in writing or is required by law.
1.5 Cancellations by the Academy: If the Academy cancels a session, a make-up class, credit, or refund (at the Academy's election) will be offered.
1.6 Fee adjustments: The Academy may adjust fees where reasonably necessary. Fee changes apply immediately to new enrolments. For existing enrolments, at least 14 days' notice will be given and the change will apply from the next billing cycle or term. If you do not accept a fee increase, you may withdraw before it takes effect, with the enrolment ending at the end of the current paid period or term.
1.7 Withdrawal during term: Where you withdraw part-way through a term, fees already paid for that term are non-refundable unless required by law. The Academy may offer, at its discretion, a credit minus reasonable administration costs.
1.8 No set-off: Amounts payable must be paid without set-off or deduction.
2. Behaviour, Venue Rules, Property, and Code of Conduct
2.1 Students must behave respectfully, follow reasonable instructions, and participate safely. Bullying, harassment, abuse, discrimination, or deliberate disruption is not accepted.
2.2 Parents/guardians must treat staff and students respectfully and comply with venue safety rules. The Academy may restrict parent presence in classrooms to minimise disruption.
2.3 You are responsible for loss or damage caused by your or the student's negligence, misuse of property, or failure to follow instructions.
2.4 Personal property is brought at your own risk. The Academy is not responsible for loss or theft of belongings unless caused by the Academy's negligence.
2.5 Recording: Audio/video recording in class by parents or students is not permitted without prior written approval.
3. Right to Refuse, Suspend, or Discontinue Tuition
3.1 The Academy may, acting reasonably and at its sole discretion, refuse, suspend, or discontinue enrolment where:
(a) fees are unpaid, repeatedly late, a payment plan is breached, or a payment is dishonoured;
(b) behaviour by the student or parent is abusive, unsafe, discriminatory, disrespectful, or significantly disruptive;
(c) despite reasonable support, the program is unsuitable for the student's needs, there is persistent non-engagement, or reasonable participation requirements are not met, and further adjustments are not practicable without unjustifiable hardship;
(d) there is a material safety or welfare risk to the student or others;
(e) classes are restructured, a teacher becomes unavailable, or minimum numbers are not met; or
(f) compliance with law, venue rules, or child-safety obligations requires it.
3.2 Any prepaid amounts for unused sessions may be credited or refunded at the Academy's discretion, except where termination is due to misconduct, safety risk, or breach by you, in which case no refund is required to the extent permitted by law.
4. Health, Medical, Safety, and Supervision
4.1 Disclosure: You must disclose all medical, behavioural, or learning conditions relevant to participation and update promptly if these change.
4.2 Medication and emergencies: You authorise staff to provide basic first aid and, in an emergency, to obtain medical assistance; you agree to pay related costs. The Academy does not administer medication unless a written health plan is agreed in advance.
4.3 Fitness to attend: Students must not attend when unwell, infectious, or where attendance would breach public-health guidance.
4.4 Supervision window: Supervision is provided only during scheduled class times. Parents must ensure timely drop-off and pick-up. The Academy may charge a reasonable late-pickup fee.
5. Inclusion and Anti-Discrimination
5.1 The Academy complies with anti-discrimination laws and will consider reasonable adjustments where practicable and safe.
5.2 Nothing in these Terms requires the Academy to deliver services it cannot reasonably or safely provide or that would cause unjustifiable hardship.
6. Online Classes and Technology
6.1 Where classes are delivered online, you are responsible for providing adequate internet, device, and a quiet environment. The Academy is not responsible for local connectivity or hardware issues.
6.2 For safety and engagement, the Academy may require cameras on during sessions unless a reasonable adjustment is agreed.
6.3 The Academy does not routinely record online classes. In exceptional circumstances, the Academy may make a limited recording only where reasonably necessary for child safety, incident review, staff training, or to comply with legal or regulatory obligations. Any such recording will be stored securely, access will be restricted to authorised management, the recording will not be published, and it will be retained only for as long as reasonably required, then deleted.
7. Learning Materials and Intellectual Property
7.1 All materials (digital or physical) remain the Academy's property unless stated otherwise.
7.2 A limited, non-transferable licence is granted for home study by the enrolled student only. You must not reproduce, post, sell, or share materials externally without written consent.
8. Photography and Media
8.1 No photography or recording without consent: The Academy will not take any photos or videos of a student unless a parent or guardian has provided express consent.
8.2 Use of photos, videos, and names (with consent): Where consent is provided, the Academy may take and use photos or short videos of students during lessons or events for educational and promotional purposes, including use on the Academy's website, social media, newsletters, and printed materials, to celebrate student achievements or share learning experiences. A student's name may be included where appropriate.
8.3 Withdrawal of consent: Any consent given under this clause may be withdrawn at any time in writing, effective going forward. Withdrawal of consent does not affect any use already made prior to the withdrawal.
9. Privacy and Communications
9.1 The Academy collects and stores personal information of parents, guardians, and students to deliver classes, manage safety, administer enrolments, maintain academic records, and communicate with you. Information may be shared where reasonably necessary for operations, including with teachers, administrative staff, payment processors, IT service providers, and emergency services, or as required by law.
9.2 Communications (private channels): You consent to the Academy contacting parents/guardians (and, where appropriate, students) via email, SMS, phone, and the Academy's approved platforms or portals for notices, scheduling, academic updates, class materials, safety matters, behaviour matters, and accounts.
9.3 Group communications channels (opt-in): The Academy may offer optional group communication channels (such as WhatsApp, email groups, or similar platforms) for general updates and coordination. Participation in any group channel is voluntary and requires express opt-in. If you opt in, you acknowledge that other participants may see your name, profile image, and/or contact information (including phone number). You may opt out or withdraw from group channels at any time by notifying the Academy. If you do not opt in (or you withdraw), the Academy will communicate with you via private channels under clause 9.2. The Academy is not responsible for the actions of other group participants and cannot control disclosures made by other participants.
10. Academic Outcomes, ACL, Risk, Liability, and Indemnity
10.1 Academic outcomes: Learning progress varies by student and many factors. The Academy does not guarantee grades, test scores, admission outcomes, scholarship offers, selective school entry, NAPLAN/HSC results, or any specific academic outcomes.
10.2 Australian Consumer Law (ACL): Nothing in these Terms excludes or modifies consumer guarantees that cannot be excluded under the ACL.
10.3 Limitation of remedies: Where services are not of a kind ordinarily acquired for personal, domestic, or household use, the Academy's liability for breach of a consumer guarantee is limited, at its option, to (a) resupplying the services; or (b) paying the cost of having the services supplied again.
10.4 Assumption of risk: Normal attendance involves ordinary and inherent risks, including but not limited to slips, falls, minor bumps, illness, allergic reactions, or other unforeseeable incidents. Participation is at your and the student's own risk, and you acknowledge these inherent risks.
10.5 General limitation: To the extent permitted by law, the Academy and the Covered Persons are not liable for indirect or consequential loss, loss of opportunity, loss of profit, or any harm arising from the inherent risks of participation, including illness, injury, or unforeseen incidents.
10.6 Release and hold harmless: To the extent permitted by law, you release and hold harmless the Academy and all Covered Persons from any claim, demand, or liability arising from ordinary and inherent classroom risks (including injury, illness, allergic reactions, or unforeseen incidents), or from your or the student's breach of these Terms.
10.7 Indemnity: You indemnify the Academy and the Covered Persons against claims, costs, and liabilities arising from (a) your or the student's breach of these Terms; (b) misuse of property; or (c) your wilful misconduct or negligence.
11. Third-Party Venues and Events
11.1 Where classes occur at a school, community centre, or other third-party venue, you must comply with that venue's rules. The Academy is not responsible for hazards or services controlled solely by the venue, except to the extent of the Academy's negligence.
11.2 Services may be delivered across multiple locations, including Academy-operated premises and partner or community premises. The Academy may allocate or change rooms and/or locations where reasonably necessary for capacity, staffing, operational efficiency, or safety. Reasonable notice will be provided where practicable.
12. Force Majeure
The Academy is not liable for delay or failure caused by events beyond its reasonable control (for example, illness, emergencies, transport disruption, power or network outages, government orders, or venue closure). Reasonable alternatives such as make-up classes, online delivery, credit, or refund will be offered where feasible.
13. Changes to Classes and Terms
The Academy may, at its discretion and at any time, vary class times, teachers, formats, curriculum, delivery methods (including switching between in-person and online), group sizes, or venues where reasonably necessary for operational, educational, safety, or staffing reasons. Reasonable notice will be provided where practicable. Updated Terms and any program changes take effect immediately for new enrolments and from the next term or booking for existing enrolments, unless otherwise required by law.
Classes may be combined across year levels (for example, Years 7/8, 9/10, 11/12) and/or streamed by ability where reasonably necessary, and the Academy will use reasonable differentiation to support mixed cohorts.
If a change under this clause materially reduces the service you reasonably expected (for example, a permanent change of venue for the enrolled program), you may withdraw before the change takes effect, with the enrolment ending at the end of the current paid period or term, unless otherwise required by law.
14. Dispute Resolution
You agree to raise any concerns or disputes in writing to the Academy first and allow a reasonable opportunity to respond.
15. Social Media and Public Communications
You must not publish, share, or distribute: (a) confidential information about the Academy, its staff, students, or families; (b) personal information or images of any student (other than your own child) without permission; (c) content that is threatening, harassing, abusive, or discriminatory; or (d) defamatory statements.
Concerns should be raised first using the Dispute Resolution process in clause 14. Nothing in this clause prevents you from making a complaint to a regulator, leaving an honest review, or exercising any rights you have under the Australian Consumer Law.
16. Electronic Transactions and Signature
Acceptance electronically (for example, ticking "I agree", typing your name, or submitting the online form) has the same effect as a handwritten signature.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the exclusive jurisdiction of its courts.
18. General
18.1 If any clause is invalid, the remainder continues in force.
18.2 A failure to enforce any clause is not a waiver.
18.3 These Terms, the enrolment details, and any written variations constitute the entire agreement between the parties and supersede all prior discussions, representations, or understandings, whether written or oral.
